# Performance Agreement (New Zealand)

## 4. Fees & GST

## 5. Overtime
Overtime beyond the booked finish time is charged at NZ$[Rate] per 30 minutes,
agreed verbally on the night and invoiced after the event. The performer is
not obligated to extend if doing so breaches venue curfew, transport, or rest
requirements.

## 6. Travel, Accommodation & Meals
- Travel inside [home region] is included. Outside that region: NZ$[Rate]/km
 return, plus parking and tolls at cost.
- For events requiring overnight stays, the client provides reasonable
 accommodation (private room, no shared bedding) for [N] people.
- For events longer than [4] hours on-site, the client provides a hot meal
 and drinking water for each performer.

## 7. Cancellation & Postponement
- **By the client:**
 - 60+ days before event - deposit non-refundable.
 - 14–59 days before - 50% of total fee payable.
 - 0–13 days before - 100% of total fee payable.
- **Postponement:** The deposit may be transferred once to a new date within
 12 months, subject to availability. Further postponements forfeit the deposit.
- **By the performer:** If the performer cannot perform due to illness, injury
 or other personal reason, they will (a) refund all monies paid, or (b) where
 possible, arrange a comparable replacement at no extra cost to the client.

## 8. Force Majeure
Neither party is liable for failure to perform due to events outside their
reasonable control (natural disaster, government order, pandemic-related public
health restriction, venue closure, etc.). In that case both parties will use
best efforts to reschedule. If rescheduling is not possible, the deposit is
retained to cover preparation work already done.

## 9. Power, Access & Working Conditions
- The client ensures: a secure, weather-protected performance area; safe
 vehicle access for load-in and load-out within [30] metres of the stage;
 adequate power (minimum [2 × 10A] separate circuits); and a safe noise
 level under the venue's terms.
- The performer arrives in time to soundcheck and observes the venue's
 reasonable rules (volume limits, curfews, drinking policies on stage).

## 10. Equipment, Liability & Insurance
- The performer carries public liability insurance to NZ$[2,000,000] and will
 provide a certificate of currency on request.
- The performer is responsible for their own equipment. The client is
 responsible for damage to performer equipment caused by guests or venue
 staff.
- The performer is not liable for indirect losses or for any loss arising
 from the client's failure to provide power, access, or accurate event
 information.

## 11. Recording & Promotion
The performer may take photos and short video clips for portfolio and social
media use, unless the client opts out in writing. The client may share
performer photos and tag the performer on social media, subject to the
performer's name and brand being credited.

## 12. General
- This agreement is governed by the laws of New Zealand.
- Variations to this agreement must be in writing (email is sufficient).
- If any clause is unenforceable, the rest of the agreement remains in effect.
